A stepfather using the image-generating AI of billionaire transphobe Elon Musk allegedly made 7,000 sexually explicit images and videos from a photo of his 11-year-old stepdaughter, including images of her nude, being raped by multiple men, and performing sexual acts on her stepfather, a class action lawsuit against Musk’s AI company alleges, as reported by NPR as reported by NPR.

The lawsuit against the billionaire transphobe’s company, SpaceXAI (previously known as xAI), alleges that its image-generation models allow users to regularly create child sex abuse material (CSAM) without notifying legal authorities as required by law.

In the case of the stepdaughter (who is now in her 20s), SpaceXAI reportedly only sent one tip about the CSAM images, as required by law, to the nonprofit National Center for Missing and Exploited Children (NCMEC). SpaceXAI didn’t include any images with its report or the stepfather’s IP address, even after NCMEC officials and legal authorities made multiple requests for the information.

When the stepfather was finally tracked down by authorities, he admitted to sharing the images online. Two days after being charged for doing so, he took his own life.

“They had everything they needed to help law enforcement stop the person responsible and achieve justice. Instead, they remained silent and allowed this person to use Grok to steal my childhood,” the plaintiff, known only as Jane Doe 4 said, according to Ars Technica. “This technology is a free, easily accessible weapon put into the hands of the worst people in the world. What is so dangerous is there is no way to prevent a predator from taking any photograph—not just a photograph on the internet—but any photo of a child and using this technology to create images from your worst nightmares. No one is safe—not adults, not children, not anyone.”

Stability AI, another company’s image-generation model, has also been named as a defendant in the lawsuit. The lawsuit accuses Stability AI and SpaceXAI of producing CSAM, benefiting from sex trafficking ventures, negligence, defective product design and creating a public nuisance.

“Public nuisance means that this is not just something that is problematic for our clients… this is something that is a scourge on society,” said Annika Martin, an attorney for all five plaintiffs in the lawsuit. “We want to put these guardrails in place so that we do not cause this harm across an entire generation of children.”

Thousands of people may be eligible to join the class action suit against these companies, lawyers told Ars Technica.
